What is the European Data Act? The European Data Act (Regulation (EU) 2023/2854) entered into force on 12 September 2025. This regulation aims to make access to and sharing of data fairer and more transparent for citizens, businesses, and public authorities. It complements the GDPR, which focuses on the protection of personal data, while the Data Act focuses on the accessibility and reuse of non-personal data. What does the Data Act regulate in practice?

  • Users gain access to the data generated by their devices.
  • This data must be shareable with third parties, such as service providers or repair companies.
  • New rules for cloud switching apply, making it easier to move between providers.
  • Public authorities may gain access to certain data in emergency situations.
